in order to implement the spirit of the Fourth Plenary Session of the 19th Central Committee of the Communist Party of China and the spirit of the national ecological and environmental protection conference, and the requirements of the guiding opinions of the State Council on strengthening and standardizing the in-process and post event supervision, and the notice of the General Office of the State Council on printing and distributing the implementation plan of pollutant discharge control permit system, the Ministry of ecological environment has continuously promoted the quality supervision of environmental assessment documents and the post supervision of pollutant discharge permits.
In the first half of the year, the Ministry of ecology and environment issued the notice on strengthening the quality supervision of the preparation of environmental impact report (form), requiring all localities to take the Shenzhen Bay incident as a reference, draw inferences from one instance, and carry out special inspection on the quality of EIA documents. Recently, the Ministry of ecological environment has transferred a batch of clues of serious quality problems found in environmental assessment documents to the ecological environment departments of six provinces (regions) including Zhejiang, Jiangxi, Hunan, Guangdong, Guangxi and Sichuan, requiring investigation and evidence collection in accordance with the law, and investigating and punishing the existing illegal acts according to law. If suspected of committing a crime, it will also be transferred to the judicial organ for criminal responsibility, thus continuing the quality control As the core of the regulatory situation, strengthen the deterrence and warning of illegal activities such as fraud in environmental impact assessment. The "notice on strengthening law enforcement in the cleaning up and rectification of pollution discharge permits and the registration of emission permits for fixed pollution sources" was issued to further standardize the methods and contents of law enforcement inspection in the cleaning up and rectification of fixed pollution sources and license issuing and registration. Since the beginning of this year, we have carried out spot checks on the quality of the rectification work, involving more than 700000 pollution discharge units; we have inspected the submission of the implementation reports submitted by 156200 licensed units before 2019, and urged to submit annual and quarterly implementation reports on schedule.
in order to further strengthen the supervision of environmental impact assessment and pollution discharge permit, and promote the institutionalization and normalization of supervision, the Ministry of ecological environment recently issued the "action plan for supervision of environmental impact assessment and emission permit (2021-2023)", which deployed the relevant work. It is required that the ecological and environmental departments at all levels attach great importance to and seriously deploy, formulate and organize the implementation of the regulatory action plan and 2021 annual work plan of their respective administrative regions.
According to the action plan, the ecological and environmental departments at all levels should focus on the outstanding problems in key areas and industries, focus on the illegal and illegal behaviors that affect the effectiveness of the environmental impact assessment system at the source of prevention, affect the full coverage of pollution discharge permits of fixed pollution sources, and focus on the public's reflection. They should seriously investigate and punish according to law, and severely crack down on and curb the falsification, shoddy manufacturing and non implementation of EIA requirements Illegal behaviors such as pollution discharge without license and discharge without certificate. All localities should formulate regulatory action plans from 2021 to 2023, and formulate and implement annual work plans annually.
The action plan emphasizes that the ecological and environmental departments at all levels should carry out supervision and control around "quality" and "implementation". According to the EIA of construction projects, the review of EIA documents, the implementation of EIA documents and approval requirements, the legal compliance of EIA of EIA projects in environmental impact registration form, the implementation of planning environmental impact reports in key areas, and the issuance, registration and implementation of pollutant discharge permits are carried out for planning EIA.
According to the action plan, the ecological and environmental departments at all levels should adhere to the improvement of regional environmental quality as the core, combine random supervision with targeted supervision, and implement classified disposal according to the impact on the ecological environment. The environmental impact assessment and pollutant discharge permit management departments and the comprehensive law enforcement departments of ecological environment should coordinate and link up the examination and approval with the administrative law enforcement to form a regulatory joint force.
